1. Introduction
These Connect Club Subscription Terms and Conditions (the “Terms”) govern your participation in Petderm’s Connect Club email subscription program (“Connect Club”). By subscribing to Connect Club, you agree to abide by these Terms, which constitute a legally binding agreement between you and Petderm.
2. Subscription
2.1 Eligibility. To subscribe to Connect Club, you must be at least 18 years old and have the legal capacity to enter into contracts. Your Connect Club subscription can only be used by you and adult family members within your household, with respect to the care of your pet or pets. Your subscription may not be shared with any person outside of your household or any organization.
2.2 Consent. By subscribing to Connect Club, you consent to receive emails from Petderm, which may include occasional promotional, informational, and transactional content related to the services and products offered by Petderm.
2.3 Opt-Out. You have the right to unsubscribe from our email list and Connect Club at any time. To unsubscribe, you can follow the instructions provided in the emails you receive from Petderm or contact us at 403 370 8800. Connect Club is non-refundable.
2.4 Renewal. At the expiry of your subscription period, you may renew your Connect Club subscription by providing notice to Petderm by email or phone at 403 370 8800 and making arrangements for payment.
2.5 Fees. Petderm may increase Connect Club fees from time to time at its sole discretion. Any fee increase shall only apply to payments for future subscription periods and shall not be applied retroactively for payments already made.
3. Use of Information
3.1 Privacy. Petderm respects your privacy. We will collect, store, and process your personal information in accordance with our Privacy Policy, which can be found on our website, and privacy laws in Alberta.
3.2 Use of Email. We will use your email address solely for the purpose of sending you emails related to Connect Care and Petderm’s services, promotions, and relevant information. We will not share your email address with third parties without your explicit consent unless legally required to do so.
4. Content and Frequency
4.1 Content. The content of Connect Clu emails provided to you may include, but is not limited to, responses to your specific inquiries regarding your pet or pets, announcements, promotions, health tips, educational information, and updates from Petderm.
4.2 Frequency. The frequency of emails provided to you by Petderm may vary, particularly in relation to how often you contact us with questions and concerns. We aim to provide valuable and
relevant content without causing inconvenience. You may receive emails on a regular or periodic basis.
4.3 Response Time and Operating Stability. Petderm aims to provide a high degree of operating stability but is not responsible for any breakdown or delay in communication caused by factors beyond its control. Such factors include, but are not limited to power failures, errors or failures in modem equipment or ADSL connections, telecommunications connection, human error, or the like. In all events, Petderm aims to re-establish normal operations as soon as possible. Petderm shall not be liable for any medical issue, the decline in health, or worsening of symptoms with respect to your pet caused or contributed to by any email delay or delivery failure.
5. Liability
5.1 Petderm has taken reasonable measures to ensure that its email service is free from viruses, bugs, defects, malfunctions, and trojans horses, but no warranty is given to this effect and Petderm shall have no liability if this is not the case.
5.2 Your use of Connect Club is at your own risk. Petderm shall not be liable to you or any third-party for any indirect, punitive, or other damages or losses arising out of the use of or inability to use Connect Care. In any event, Petderm’s liability will be limited to a total aggregate amount of the value of the subscription fees paid by you for the period of 12 months before the occurrence of the incident giving rise to the liability.
6. Intellectual Property
6.1 Ownership. All content, including text, images, logos, and trademarks, provided to you in the emails and related communications is the property of Petderm and is protected by copyright and intellectual property laws.
6.2 Use Restrictions. You may not reproduce, distribute, or use the content provided in our emails for any commercial purpose without our prior written consent. Responses to questions, advice, and information provided to you by Petderm with respect to your specific pet is intended to apply only to your pet and its specific health concerns and circumstances. It is not intended to be shared with other pet owners and may not apply to other pets. Improper application of information or advice provided by Petderm could be dangerous or detrimental to the health of any animal for which it is not directly provided.
7. Termination
Petderm reserves the right to terminate or suspend your subscription to Connect Club at any time and for any reason, including but not limited to violation of these Terms.
8. Amendments
Petderm may update or modify these Terms from time to time at its sole discretion. We will notify you of any material changes to these Terms through email. Your continued use of Connect Club after receiving such notification constitutes your acceptance of the revised Terms.
